These Terms of Service govern your use of the Evity Club iOS application and the website at evityclub.com. By creating an account or using the service, you agree to these terms. Please read them carefully.
Evity Club is operated by Evity Club AB, a company registered in Sweden with organisation number 559355-0766. References to "Evity Club", "we", "us", and "our" in these terms refer to Evity Club AB.
Evity Club is a personal performance app that reads biometric data from your wearable device and uses it to calculate a Decision Readiness score. The app also includes tools for weekly planning, daily reflection, and team performance tracking.
Evity Club is not a medical device and does not provide medical advice. The Decision Readiness score and any other outputs from the app are for informational and personal productivity purposes only. They are not intended to replace professional medical judgement, and you should not make health-related decisions based solely on information provided by Evity Club. If you have concerns about your health, consult a qualified healthcare professional.
Nothing in these terms affects your mandatory rights under EU or Swedish consumer law, including rights under the EU Digital Content Directive (2019/770) as implemented in Swedish law. Where these terms conflict with mandatory consumer rights that cannot be waived by contract, the mandatory rules apply.
You must be at least 18 years old to use Evity Club. By using the service, you confirm that you meet this requirement. We do not knowingly allow minors to create accounts. If we become aware that a user is under 18, we will close the account.
You are responsible for keeping your account credentials secure and for all activity that takes place under your account. You must notify us immediately at [email protected] if you believe your account has been compromised.
You may not create an account on behalf of someone else without their explicit consent. Each account is for a single individual.
Evity Club is a subscription service. A 14-day free trial is available to new users. After the trial period, continued use requires an active paid subscription.
Subscriptions are managed through RevenueCat and processed via the Apple App Store. By subscribing, you also agree to Apple's payment terms. All prices are shown in euros, inclusive of applicable taxes where required by law.
Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before renewal. You can manage and cancel your subscription at any time through your Apple ID account settings.
All refunds, including the statutory 14-day right of withdrawal that applies to EU consumers for digital services, are governed by and handled through Apple's App Store terms and procedures. If you wish to exercise your right of withdrawal or request a refund, please do so through your Apple ID account or at reportaproblem.apple.com.
We reserve the right to change subscription pricing. We will give you at least 30 days' notice of any price change, and the new price will apply from your next renewal date. If you do not agree with a price change, you may cancel before it takes effect.
Evity Club connects to third-party wearable devices and health platforms, including WHOOP, Oura Ring, and Apple HealthKit. By connecting a wearable, you authorise Evity Club to read health data from that device on your behalf in accordance with our Privacy Policy.
Evity Club is not affiliated with, endorsed by, or officially connected to WHOOP, Oura, or Apple. Availability of third-party integrations may change if those providers modify or discontinue their APIs. We are not responsible for interruptions to the service caused by changes on the part of wearable providers.
You agree not to:
Content you create in Evity Club, such as journal entries, decision notes, and weekly planning entries, belongs to you. You grant Evity Club a limited licence to store and process that content solely for the purpose of providing the service to you.
Journal and decision entries are encrypted on your device before storage. Evity Club cannot access the content of those entries. See our Privacy Policy for details.
You are responsible for the content you enter into the app. Do not enter information that you would not want stored, even in encrypted form.
Evity Club includes optional team features that allow multiple users to share aggregated performance data with each other. Participation in a team is voluntary and requires explicit consent from each member at the time of joining. You may leave a team at any time from within the app. Leaving a team stops your data from being shared with that team going forward.
Evity Club and all content, features, design, trademarks, and technology within it are owned by Evity Club AB or its licensors. Nothing in these terms grants you any right to use our name, logo, or any other intellectual property without our prior written consent.
We aim to keep Evity Club available at all times, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time. We will give reasonable notice of material changes where possible.
We will provide updates, including security updates, that are necessary to keep the app in conformity with these terms and fit for its intended purpose during your active subscription. Some updates may be required to continue using the service.
If the service materially fails to conform to what is described in these terms, you have the right to ask us to bring it into conformity. If we cannot do so within a reasonable time, you may be entitled to a price reduction or, in cases of serious non-conformity, to terminate your subscription and receive a proportionate refund. These rights are in addition to any rights available through the Apple App Store.
To the fullest extent permitted by applicable law, Evity Club AB is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including loss of data, loss of revenue, or business decisions made in reliance on Evity Club outputs.
Our total liability to you for any claim arising from these terms or your use of the service is limited to the amount you paid us in the 12 months preceding the claim. This cap does not apply to claims based on mandatory consumer rights or statutory remedies for non-conforming digital content.
Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, gross negligence, intentional misconduct, fraud, or any other liability that cannot be limited by law under mandatory Swedish or EU consumer protection rules.
You may close your account at any time from Settings within the app, or by contacting us at [email protected]. Before your account is deleted, you may request an export of your data by emailing [email protected]. We will provide a copy of your retrievable content within 30 days of your request. After that window, data is deleted in accordance with our Privacy Policy.
We may suspend or terminate your account if you breach these terms, if your subscription lapses and is not renewed, or if we discontinue the service. We will give you reasonable notice where possible.
These terms are governed by Swedish law. Any dispute arising from these terms or your use of the service that cannot be resolved amicably will be subject to the exclusive jurisdiction of the courts of Sweden. If you are a consumer based in another EU member state, you may also have the right to bring proceedings in your local courts under mandatory consumer protection laws.
EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
We may update these terms from time to time. When we make material changes, we will notify you by email or by a notice inside the app at least 30 days before the changes take effect. If you do not agree with updated terms, you may close your account before the changes take effect. For material changes that alter your core rights or the core features of the service, we will ask for your explicit acceptance inside the app before the new terms apply.
